1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.monikahoyt.com (the “Site”), operated by Monika Hoyt Coaching Services, LLC, d/b/a The Couples Cure (“Company,” “we,” “us,” or “our”), together with any coaching, courses, live Q&A sessions, content, and related services we offer (collectively, the “Services”). By accessing or using the Site or the Services, you agree to be bound by these Terms and by our Privacy Policy, available at www.monikahoyt.com/privacy-policy. If you do not agree to these Terms, do not use the Site or the Services.

2. Eligibility

You must be at least 18 years of age to use the Site or the Services or to register for an account. By using the Site, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

3. Description of Services

The Company provides relationship coaching, online courses, live Q&A sessions, and related educational content. The Services are educational and coaching in nature and are not a substitute for therapy, medical care, or mental health treatment. If you are experiencing a mental health crisis, please contact a licensed professional or emergency services.

4. Purchases, Payments, and Refunds

Certain Services, including coaching packages, courses, and workshops, are offered for purchase directly through the Company. When you make a purchase, you agree to provide accurate billing and payment information and authorize us (or our third-party payment processor) to charge the applicable fees to your chosen payment method.

  • All fees are due at the time of purchase unless otherwise stated in a specific program’s payment plan.
  • Prices for coaching packages, courses, and workshops are subject to change; changes will not affect purchases already completed.
  • Refund and cancellation terms, if any, will be disclosed to you at the time of purchase for the specific program or service and, where applicable, will control over this general section.
  • Payment processing is handled by third-party payment processors; the Company does not store full payment card information.

5. Your License to Us

By posting or submitting any material (including comments, blog entries, social media posts, photos, and videos) to us via the Site, internet groups, or other digital venues, you represent that you own the material or have obtained the necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, sell, exploit, create derivative works from, distribute, and publicly perform or display such material.

6. Registration & Passwords

To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

If you suspect unauthorized use of your account, notify us immediately at Monika Hoyt Coaching Services, LLC. We are not liable for any loss or damage arising from your failure to comply with this obligation.

7. SMS Text Messaging Terms

If you opt in to receive text messages from us, the following terms apply:

You can cancel the SMS service at any time. Just text “STOP” to (952) 900-6292. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at monika@monikahoyt.com.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive no more than 4 messages per week. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Carriers are not liable for delayed or undelivered messages.

8. Intellectual Property

All content on the Site, including text, graphics, logos, course materials, videos, and the compilation thereof, is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except as necessary to use the Services for their intended personal purpose.

9. Prohibited Uses

You agree not to:

  • Use the Site or Services for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to the Site, other accounts, or Company systems
  • Interfere with or disrupt the operation of the Site
  • Reproduce, resell, or redistribute course content or coaching materials without our written consent
  • Use automated means (bots, scrapers) to access or collect data from the Site

10. Disclaimers

Throughout the Site, we may provide links and pointers to Internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites or the information, products, or services offered on or through the sites.

The information, products, and services offered on or through the Site are provided “as is” and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

You agree at all times to indemnify and hold harmless Monika Hoyt Coaching Services, LLC, its affiliates, and their respective officers, directors, agents, and employees from any claims, causes of action, damages, liabilities, costs, and expenses arising out of or related to your breach of any obligation, warranty, or representation under these Terms of Service.

11. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall the Company, its affiliates, or their respective officers, directors, agents, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or the Services, even if advised of the possibility of such damages. The Company’s total liability arising out of or related to these Terms or the Services shall not exceed the amount you paid to the Company in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our discretion. You may stop using the Site or Services at any time.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Minnesota.

14. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated effective date. Your continued use of the Site or Services after any changes constitutes your acceptance of the revised Terms.
